Childrens' Rights Seminar Presented by PHLO and IMPACT
At 7pm on November 27, 2006 at IMPACT of Silver Spring, Patrick Hoover presented a seminar titled Children's Rights: What Parents Need to Know. The seminar was held at the Adventist Community Services Center at 501 Sligo Avenue in Silver Spring, Maryland. The attendees were a dynamic group of parents involved in the IMPACT in the Schools Parents Initiative, led by Raymond Moreno of IMPACT Silver Spring.

Patrick spoke at length about current legal issues and solutions for situations involving juveniles attending general public schools, parents and juveniles involved in the juvenile justice system, and parents requesting special education services under the IDEA for their children. Parents at the seminar asked many questions involving their own children's situations, such as how to request an IEP meeting, whether they were forced to medicate their children if the school recommended medication, whether school records were public and permanent, and what to do in situations where a juvenile is in trouble with the law and DJS is involved. Patrick offered much practical advice to these parents, and even gave an example of an initial consultation for a parent in the group involved in securing special education services for her son.

Reconnecting at Wrightslaw Seminar, Columbia MD Wrightslaw Seminar, November 10 and 11, 2006 at Howard Community College in Columbia Maryland.

We attended the Wrightslaw Seminar to reconnect with Peter and Pamela Wright, founders of the Wrightslaw website and fellow practitioners in the special education field.

Two New Student Free Speech Cases The Supreme Court has been asked to hear two separate school free speech/censorship cases involving two very different high school students. Both cases come out of the far west and in both, the high school students were suspended by their school for wearing to school a T-shirt with language found so offensive as to violate school policy and warrant out of school suspension.

In
Harper v. Poway Unified School District a student’s T-shirt read "homosexuality is shameful", while in Juneau School Board v. Frederick, No. 06-278 a student wore "Bong Hits 4 Jesus" on his shirt. In both cases the students have appealed their suspensions under the 1st Amendment to the US Constitution. In one case the court ruled in favor of the local school and the suspension imposed. In the other case, the courts have so far ruled against the school’s suspension.

There is a split in the federal circuits which ruled on these appeals and there is reason to expect the US Supreme Court may agree to hear both cases and settle once and for all that oh so important question: exactly what language can a high school kid wear on their T-shirt?

Actually, the cases are very interesting on a number of levels – involving not only free speech but also school safety and school policy when confronted with issues involving free speech - and the question of whether the high court even agrees to decide the cases, much less what their decision(s) will be, are quite significant.

New On Line IEP Tool for ALL Maryland Students Johns Hopkins University’s Center for Technology in Education, partnered with the Maryland State Department of Education (MSDE) has developed an important new web site for use with the creation and update of All Maryland State students with an Individualized Education Plan (IEP). Before long each Maryland school district will begin to follow the new law and start to develop their student IEP’s on line using the special features afforded with this unique on line software. The on line IEP’s will host the data and make it available from any computer with internet access.

The program design appears quite sophisticated and capable of addressing virtually all of the IEP parts under the new federal law. Time will undoubtedly reveal the usual bugs and glitches found in all new programs. We worry that such mistakes could prove doubly disastrous for effected students.

If your child is provided an IEP, we encourage you to explore this new site, take the demo, read the extensive documentation available on line and get ready for special education in the age of the internet!
